That evidence was taken very seriously by prosecutors. “We punish those who make bad judgments when they should have known better and could have done things differently.” And, given the significant schizophrenia and paranoid delusions, audible, visual hallucinations that she was experiencing, I am convinced, based on the evidence I’ve seen and the information presented in court, that this woman did not know right from wrong and could not have acted any differently than she did.

“I was convinced of it, and I felt compelled to take these steps in the interest of justice,” stated George Brauchler, the 18th Judicial District Attorney at the time.

Guzman spoke with Sallinger about her mental state seven years later, stating she is ready to return to society.

Guzman claims she was sexually assaulted in a closet at the state hospital and filed a police report accusing an employee of sexually assaulting her. She informed Sallinger that the same employee had been involved in two prior incidents.

She wants him charged, but the district attorney’s office in Pueblo claimed it had never received a case like the one from the hospital police when Guzman was interviewed in November. CBS4’s request for information was denied by the Colorado Department of Human Services, citing privacy regulations.

While Guzman wants that employee penalized, she told Sallinger that the most important thing to her is to be released.

“If I had the ability to modify it or take it back, I would.”

In early March, Sallinger contacted Guzman again. She told him at the time that a hearing on her request for increased freedom in the hospital was scheduled on March 11, but that it had previously been postponed.

She said she had met with the Pueblo County District Attorney’s Office about the assault allegations. Guzman claims she was told that the hospital’s report was written in such a way that it would be difficult to prosecute charges, especially considering the passage of time.
